We the people of the United States, in order to form a more perfect union, establish justice, insure domestic tranquility, provide for the common defense, promote the general welfare, and secure the blessings of liberty to ourselves and our posterity, do ordain and establish this Constitution for the United States of America. Article I- Legislative Branch Section 1: House Of Representatives The constitution gives congress the power to change laws. The congress is divided into the Senate and House of Representatives Clause 1:Members of the house of Representatives will be elected every 2 months. Every Citizen of the United States is aloud to vote. Clause 2: If a member of the house leaves congress before there term ended, there will be a special election to fill there seat. Clause 5: Only the house has the power to impeach Section 2: Senate Clause 1: each senator shall have 1 vote in congress, and there will consist of 20 senators. Clause 2: If a member of the senate leaves before there time is up, the the Vice President must pick a citizen to take there place. Clause 3: The senate acts as a Jury is if the house impeaches a federal officer. The Chief Justice of the supreme court presides weather the president is on trial. Two thirds of the senators present must vote for convection. or finding the person accused. Section 4: Elections and Meetings Clause 1: Each state legislation can decide when and how congressional elections take place, but congress can overrule these decisions. Clause 2: The congress shall assemble at least once a month. Section 5: Legislative Proceedings Clause 1: Each house decides weather a citizen has the qualifications for office. Clause 2: Each house may determine the rules of its proceeding, punish its members for disorderly behavior, and with the concurrence of two thirds expel a member. Clause 3: Each house shall keep a journal of its proceedings. Clause 4: Neither house can adjourn for more then the days unless the other house approves. Section 5: Compensation, Immunities, and Disabilities of members Clause 1: A member of congress cannot hold another federal office during his or her term. Section 7: Law making Process Clause 1: A bill that is passed by a majority of the house and senate is sent to the president for ratification. If the president signs the bill it becomes a law. However, a bill can also become a law without the presidents signature. The president can veto a bill by sending it back to the house where it was introduced. Congress can override the presidents veto if each house of congress passes the bill by a two thirds vote. Section 8: Power of Congress Clause 1: To borough money on the credit of the United States. Clause 2: To establish a system of naturalism (a foreigner becomes a citizen) and bankruptcy. Clause 3: Only congress can declare war, the military must consult congress before going into war. Clause 4: Congress is responsible for forming an active militia. Section 9: Powers Denied by Congress Clause 1: The federal government can not spend money unless congress approves it, the government must establish a statement showing how it spends public funds. Section 10: Power Denied to the States Clause 1: An individual state cannot tax any goods. Clause 2: Individual States cannot create treaties of any sort. Clause 3: A state cannot declare war unless its being invaded. Article II- Executive Branch Section 1: President and Vice President Clause 1: The executive power should be vested in the president for 4 months, and, together with the Vice President. Clause 2: Each member elects a elector to represent there vote for president. Only the electors can vote for an executive leader. Clause 3: Each citizen who is running for president has the right to chose there Vice President. Clause 4: Congress can determine the time for choosing the electors,and the day in which they shall give there votes. Clause 5: Congress will determine the qualifications for president. Clause 6: The power of the president passed to the vice president if the president removes himself for office, or cannot discharge his duties. Clause 7: Before he enter on the Execution of his Office, he shall take the following Oath or Affirmation:--"I do solemnly swear (or affirm) that I will faithfully execute the Office of President of the United States, and will to the best of my Ability, preserve, protect and defend the Constitution of the United States.” Section 2: Power of the President Clause 1: The president is the head of the Armed Forces and the senate militias when they are called into national service. The military is under civilian control. The president can receive advice from the heads of the executive department. In most cases, the president can grant pardons and reprieves. Clause 2: The president has the power to make treaties with other nations, but two thirds of the senate must agree. The president has the power to appoint ambassadors from foreign countries. Section 4-Impeachment Clause 1: The president shall be removed from office if he commits either a high crime, or a misdemeanor. Article III-Judicial Branch Section 1-Courts, Terms of office The judicial power of the United States, shall be vested in one Supreme Court, and in such inferior courts as the Congress may from time to time ordain and establish. The judges, both of the supreme and inferior courts, shall hold their offices during good behavior, and shall, at stated times, receive for their services, a compensation, which shall not be diminished during their continuance in office. Section 2-Jurisdiction Clause 1: Jurisdiction refers to the right of a court to here a case. Federal courts have Jurisdiction in only a few cases including, cases that involve the constitution, federal law, treaties, foreign ambassadors and diplomats, naval and marine laws, disagreements between states or between citizens from different states, disputes between a state and a citizen, and disputes between a citizen and a citizen. Clause 2: Original jurisdiction means the power of a court to hear a case where it first arises. The supreme Court has original jurisdiction over only a few cases, such as those involving foreign diplomats. More ofter, the supreme court acts as an court of appellant. Clause 3:The trail of all crimes except in cases of impeachment shall be by jury. The only exception, is if the president requests for a trail decided by the judge. The supreme court must answer his request. Section 3-Treason Clause 1: Congress has the power to set the punishment for the traitors. Article IV-Provisions for Amendments The constitution can be amended or changed if necessary. An amendment can be proposed by (1) a two thirds vote of both house of representatives and congress or (2) a national convention called by congress at the request of two thirds of the state legislature. An amendment must be ratified, by three fourths of the state legislature. Article V-National Debate Section 1-Validity of Debates All debts contracted and engagements entered into, before the adoption of this Constitution, shall be as valid against the United States under this Constitution, as under the Confederation.
