In my opinion cyber bullying should only be criminalized if it actually threatens you. If it's just someone insulting you online I'm sorry if I sound rude but it technically falls under freedom of speech.

I disagree, penguin. Again, refer to my statement regarding the online disinhibition effect. It is perhaps, one of the only reasons to be used to describe any lack of understanding, and empathy one can have about trolling/cyber crimes. |

The same way abuse is a crime in reality. Emotional abuse is also a crime, no matter where you commit the atrocity. |

The only reason so many are not facing charges, is because it takes a little work. For one, the victims of these online atrocities, must open up to their parents. It is then, their parents' jobs to take the evidence of these crimes to local law enforcement. It is then their job, to get in touch with the website where the atrocity took place. It is then the website's job to hand over IP's, and all forms of identifying data about the criminal in question. It is then law enforcement's job to get ahold of the criminal's local law enforcement. (Can be anywhere in the world.), and corroborate with them. |

See here's the problem, freedom of speech in the US is very very limited, anonymity on the internet allows you to have true freedom of speech, cyber bullying laws can be heavily abused to censor people who aren't actually cyber bullying, having them is dangerous and can lead to government censorship of the internet. |

Because people need to know the truth. |

"if trolling was a crime literally thousands of kids would probably be facing charges "
Exactly this, unless its prolonged harassment it shouldn't be criminalized period, the bulk majority of the "emotional damage" caused by trolling is at the fault of the "victim" (I very much hesitate to use this term). Overall it just seems like a gigantic farce to censor and harm freedom of speech. |

"yes but i would get help like a RATIONAL person would do"
To be fair, a lot of the time said help isn't accessible due to an outside force/inside force, or getting help has been attempted, but the source of help did basically nothing.

@Green. I'm not one to believe in conspiracy theories. Everyone is responsible for their own actions. A troll instigates, thus he/she is the one at fault. Not the victim, as you perfectly stated the receiver to be. Sure, joking is fine. Not trolling. If you are deliberately trying to hurt someone in any way(Trolling), that isn't right. However, if you punk with someone, and tell them at the end of it you're only messing with them, that's not trolling. It is also best done between friends. A victim, who did nothing to warrant a session of abusive "trolling" shouldn't have to leave the site for the troll's actions. |

Also, when friends joke around harshly with one another, there is always an understanding from the start that it's all fun, and games. In the online world, this can also be true with friends you've made on here, and known for a long period of time. The psychological damage of trolling comes from the fact that there are no visual cues, tones of voice, or other hints the human brain is designed to interpret. This coupled with the fact that most victims are neither friends, nor have ever met the person before the abuse makes it clear. Depending on the state of mind of the victim, and the natural state of the human mind to imagine the person on the other end, it is clear how this could have negative affects. To be unaware of this, or lacking any care of these things suggests poor empathetic, and reasoning skills. (Social skills.) Instead, what matters more online, is communication skill, and positive/negative interpretations. If a person is trolling constantly, or appears to love causing calamity, the mind of the victim see's this as a purely emotionless, and negative person. Vise versa. Even when anonymity is taken away, disinhibition may still occur. FaceBook, and a man charged with harassment for example. He was just trolling. |

I would agree. Assuming the person harassing is really incapable of understanding he/she pushing someone out of which they have no right to do so. I think I have more an issue with the fact that said victims don't take the steps necessary to stop the abusers. It's a little work, sure, but it would make online safer for the community in whole.

@mort
that's why i just assume everyone is trolling
honestly, someone who thinks about how much he or she hates me every second of the day instead of just being angry at the time is VERY unlikely |

all i know is that people are actually getting fined and put in jail for cyber bullying
HOWEVER
this is not trolling, this is extreme cases of stalking, spamming, death threats, among other things, that may lead a person to attempting to kill themselves or killing themslves
when that happens being jailed or fined is 100% deserved
other times when it's just playful trolling i don't feel it's enough
