01-01-2016 09:40 AM NYPD Act A-02 is the Suspension Reform Act 0f 2016 IA=Internal Affairs Act A-02 was created to give more structure to the way suspensions work in NYPD. Part 1- The Internal Affairs Division has the authority to suspend anyone as they see fit. Internal Affairs has the authority to unsuspend an alter the duration of suspensions. Part 2- If an officer believes he/she was suspended falsely the officer must PM an Internal Affairs agent. IA will then launch an investigation as to see if the suspension was valid. IA will follow up on every private message they receive. Part 3- Internal Affairs has the right to investigate anyone regardless of rank. Part 4- Every officer has the right to press charges against a high rank. The high rank then must appear for a court case which is overseen by IA. If found guilty, IA will come up with an appropriate punishment for the high rank in question. Part 5- Mandatory Minimums This part outlines the mandatory minimum suspension for each crime. - Disrespecting HRs- 24 hours -Driving while cadet- Warning. If they continue- 24 hour suspension -Buying illegal guns on police team- Arrest, and possible 24 hour suspension. Reckless driving while sirens and/or lights are off- 24 hour suspension -Being on PD team while suspended- First they will be ordered to get off, if they refuse, they shall be arrested. -Killing another officer deliberately- Four day suspension -Making a checkpoint at gun shop or vis spawn- First a warning, if the officer refuses. 24 hour suspension -Abuse of tools- 24 hours In the case an officer breaks a rule that is not stated here, any HIGHCOM still has the authority to suspend them. ALL CONFLICTING LAWS/RULES/GUIDELINES ARE HEREBY DECLARED NULL AND VOID THIS ACT IS SUBJECT TO CHANGE AT ANYTIME This act will go into effect January 1 2016 Approved by NYPD HIGHCOM 1/1/16
