CHAPTER 1 - LAW ENFORCEMENT Section 1.1 [Chief of Police] • Organization of departments; duties. • The chief of police shall be the head of the police department. He and such employees shall constitute the police department. • The chief of police, shall have charge of the police department and shall be responsible in seeing that the police officers faithfully perform their duties. • Assignment of duties to police officers. The chief of police shall assign such duties to the police officers as he thinks best for the good order of the town. • Appearance of police officers. The chief of police shall see that the members of the police department present a neat and respectable appearance. Section 1.2 [Duties of police officers] Police officers of the town shall have the following duties: • To preserve public peace, prevent crimes, detect and arrest offenders, and suppress riots and unlawful gatherings which obstruct the free passage of public streets, sidewalks, and public places. • To protect the rights of persons and property. • To guard the public health. • To preserve order at all public meetings. • To regulate the movement of pedestrians and vehicles in the streets. • To enforce penalties for the violation of laws and of provisions of this Code and other ordinances of the town. • To arrest all persons guilty of violating any law or any provision of this Code or other ordinance of the town. • To serve all processes issued to them. • To perform any and all other duties that may be assigned to them by the chief of police. CHAPTER 2 - Department Appointment & Promotions Section 2.2 [Department Appointment] In order to prevent a stoppage of public business of the police service to the public, the management team may make temporary appointments to remain in force until regular appointments may be made. Provided, no person shall be temporarily appointed within the police department unless such person is certified as a police officer. Section 2.3 [Department Promotions] Promotional examinations vacancies in the departments shall be filled. Promotions shall in every case involve a material change in duties and an increase in responsibilities, and shall not be made merely for the purpose of granting a higher title or honor. CHAPTER 3 - REGULATIONS Section 3.1 [Right of Entry] All town employees and officers shall have the right, during reasonable hours, to enter any building in the discharge of their official duties or for the purpose of making any inspection, re-inspection, or test or for other lawful purposes. Section 3.2 [Prohibited Activity] The carrying on or about the person any firearm, or any weapon which by their use might, constitute a deadly weapon. Section 3.3 [Illegally Parked Vehicles] The chief of police is hereby authorized to remove or cause to be removed any vehicle from a street, sidewalk or alley which is illegally and improperly parked, in violation of a provision of this chapter or obstructing or impeding the use of the streets, sidewalks and alleys. Section 3.4 [Discharge of Firearms] No person shall discharge any firearms with force that reasonably is expected to cause bodily harm within the inhabited portion of the town. Section 3.5 [Brandishing Firearm] No person shall brandish, expose, or carelessly handle any firearms, anywhere in the town in a manner so as to endanger the life or property of any person. Section 3.6 [Failure to Assist an Officer] No person shall fail to act in making an arrest, assist any officer any way after being summoned by the officer, nor in any way interfere with or threaten or jeer at any officer in the discharge of his duty. Section 3.7 [Impersonating an Officer] No person, including any person removed or suspended from a position as a police officer, or any person who has resigned or retired from such a position, shall, within the town, falsely represent that he or she is a police officer, or shall wear in public the uniform adopted for such police officers. CHAPTER 4 - OFFENCES Section 4.1 [Disorderly Conduct] Any person who willfully engages in disorderly conduct is guilty of a class 2 misdemeanor. The following acts or activities, when performed or undertaken are hereby prohibited and declared unlawful: • Disorderly conduct is a public disturbance intentionally caused by any person who does any of the following: • Engages in fighting or other violent conduct or in conduct creating the threat of imminent fighting or other violence. • Makes or uses any utterance, or abusive language which is intended and plainly likely to provoke violent retaliation and thereby cause a breach of the peace. • Takes possession of, exercises control over, or seizes any building or facility. • Refuses to vacate any building or facility of any public or private building or facility after asked to leave. CHAPTER 5 - CONTRACTED TOWING SERVICE Section 5.1 [Towing Operations] Lizard Lick Towing & Recovery shall be the contracted company to serve the motoring public of Wendell. Tow trucks shall have the right of way in all streets and public places to perform the necessary towing or recovery operations. It shall be unlawful for any person to obstruct or interfere at scenes where tow trucks are operating at. When tow trucks are operating it is required for drivers to slow down and move over. CHAPTER 6 - ADMINISTRATION Section 6.1 [Department Control & Supervision] The Town Mayor shall have complete control and supervision of all town departmental groups. Section 6.2 [Powers & Duties] The Town Mayor and Mayor Pro Tempore shall be responsible for the proper administration of all town affairs. The Mayor Pro Tempore shall be responsible in assisting the Town Mayor with the town matters. The Town Mayor shall have the authority to appoint the Chief of Police and for any member of the police department at the joint request or consent of the department chief and Town Mayor be placed in a lower rank for reasonable reasons. Other duties and powers: • To properly plan, coordinate and direct the functions of the town government and community in a manner consistent with existing statutes and ordinances. • To employ and discharge all employees under his/her supervision, subject to statutory limitation. • To attend meetings with the right to take part in the discussion of all matters. • To direct the enforcement of all laws and ordinances within the town. • To issue, amend or repeal administrative regulations, policies and procedures for the town and town staff.
