AN ACT
To provide for limited lawmaking at the city level in order to promote realism and regulate certain items specific to cities.
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
SECTION 1. SHORT TITLE; DEFINITIONS.
(a) This Act may be cited as the "Fauxtillion Home Rule Act of 2017," named in honor of Senator Fauxtillion, the author of the City Council Act of 2015 which established local governments.
(b) The term "certain substances" as used in this Act refers to tools which have a physiological effect when activated on the user.
(c) The city councils referred to in this Act are the city councils established by the City Council Act of 2015, which consist of a lower council and a development council; it shall only require the approval of the lower council and the signature of the city's mayor to take action under section 2.
SEC. 2. DELEGATION OF AUTHORITY.
Delegated to the city councils is the power to enact laws, to have effect within the jurisdiction of that council, provided that they are consistent with federal law, and relating to—
(1) traffic and road safety;
(2) posession or use of certain substances; and
(3) posession or use of firearms.
SEC. 3. LIMITATIONS ON EXERCISE OF POWER UNDER SECTION 530D OF TITLE 28.
Notwithstanding section 530D of title 28 within the United States Code, the Department of Justice, its offices, and any employees thereof, may not establish or implement any policy to refrain from defending or enforcing this Act, nor may they contest affirmatively in any judicial, administrative, or other proceeding, the constitutionality of any provision of this Act without receiving a formal waiver of this section from Congress in the form of a concurrent resolution.
