50TH CONGRESS Constitutional Amendment H#####ES. 1 Proposing an amendment to the Constitution of the United States to provide for the activity of the Federal Court, the right to a speedy trial, and the effective administration of justice. JOINT RESOLUTION Resolved by the Senate and House of Representatives of the United States of America in Congress assembled (two-thirds of each House concurring therein), That the following article is proposed as an amendment to the Constitution of the United States, which shall be valid to all intents and purposes as part of the Constitution when ratified by the majority of the justices of the Supreme Court: “Article  — “ Section 1. The Supreme Court, with a majority vote, shall be empowered to designate a judge of the Federal Court as 'inactive'; for each such 'inactive' judge, the President shall be authorized and empowered to nominate, and by and with the advice and consent of the Senate, appoint a Special Judge of the Federal Court. “ Section 2. A Special Judge of the Federal Court shall have all powers conferred upon a regular judge of the Federal Court and shall, upon the termination of their 'inactive' judge's tenure as a judge of the Federal Court assume the role of a regular judge in the Federal Court, and their special office shall cease to exist. “ Section 3. If a Special Judge of the Federal Court is designated as inactive under section 1 of this article, they shall be immediately removed from office and their replacement's 'inactive' judge shall be the one to whom they were assigned. “ Section 4. No part of this article shall be construed as suspending, or removing the authority of an 'inactive' judge, and it is hereby reaffirmed that the only means for their removal is by impeachment, as provided in article 3 of this Constitution.”.
