51st Congress AN ACT to amend the Congressional Electoral Law to fix loopholes. Mr. Bartlett (for himself, and Mr. LordSights) introduced the following legislation into the Senate, which was referred to the Judiciary Committee. Be it enacted by the Senate and House of Representatives of the United States in Congress assembled, SECTION I. Short title (a) This bill shall be cited as the "Congressional Electoral Act of 2017". SECTION II. Congressional Committees (a) Elections for Chairperson of any House or Senate Committee shall be hosted by the Speaker or President Pro Tempore, respectively. No longer withstanding the approval and oversight of the Federal Elections Congressional Committee. (b) At any time during the term of the Chairperson or any elected member of any House or Senate Committee, the respective house may push forward, through a majority vote of all members of the respective house, a resolution of no confidence to initiative new elections for an individual to finish the term of the elected committee position. SECTION III. Majority/Minority Leader (a) Elections for the Majority or Minority Leader of the House or Senate, respectively, shall be hosted by the Speaker or President Pro Tempore, respectively. No longer withstanding the approval and oversight of the Federal Elections Congressional Committee. (b) At any time during the term of the Majority or Minority Leader of the House or Senate, the members of the caucus of the respective house may push forward, through a majority vote of all members of the respective caucus, a resolution of no confidence to initiative new elections for an individual to finish the term of the elected office. (c) In any event that the caucus of the Majority or Minority caucus changes, a member of the new respective caucus may call for a vote for a new leader of the respective caucus. The vote shall be hosted by the Speaker or President Pro Tempore, respectively. SECTION IV. Chairperson election; FECC Activity (a) In the unwarranted absence of the Chairperson of the Federal Elections Congressional Committee, the committee may, with the majority concurring, allow the Vice Chairperson or any other member to announce and host Congressional Elections. 1. The Chairperson must not have announced or hosted the Congressional Elections within 24 hours before such members of the Committee may be empowered to the provision in subsection a of section four. (b) The Chairperson of the Federal Elections Congressional Committee shall be elected for a term of one month, having the election of the Chairperson happen upon the term expiration, death, resignation or inability to exercise the office. 1. Upon the passing of this act, elections for the Chairperson of the Federal Elections Congressional Committee shall begin and any person currently exercising that office shall be subject to the election immediately. SECTION V. Severability; Conflicting Acts (a) This act shall be severable, any provision declared unconstitutional shall not immediately declare the entire act unconstitutional unless explicitly written. (b) Any U.S. Code, Congressional Act or resolution in conflict shall be considered null and void. Resolved by the Senate and House of Representatives of the United States in Congress assembled.
