ARTICLE III - JUDICIAL OPERATIONS:

SECTION I - The Judicial Branch shall consist of the following; ### ### ##### ##### Justice, two (2) Assi############################### ### ###r#######r#####tices, one (1) Appeals Advisor, four (4) Appeals Justices, one (1) District Advisor, and six (6) District Justices.
SECTION II - The Supreme Court may strike down any bill, executive order, or any other legislation that violates the Constitution or Bill of Rights. They must reach a majority (2/3) to strike the document down.
SECTION III - The Chief Court Justice and his/her Assistants are to handle all punishments deem fit given in court. They are the only ones who may rank someone "State Penitentiary".
SECTION IV - If a party deems that something in their case was mishandled, they may submit an Appeals Case, which an Appeals Justice would handle. If an Appeals case for a District case is Appealed, it would go to the Supreme Court.
SECTION V - The Supreme Court shall contain nine (9) Justices, including the Chief Court Justice and his/her assistants. The Chief Court Justice and his/her assistants count as Supreme Court Justices. Supreme Court Justices are nominated by the Governor, confirmed by a simple majority (½) in the Senate, and serve for life in the Supreme Court, unless they resign, or are impeached.
SECTION VI - The Chief Court Justice, his/her assistants, and the Court Justices are able to issue Arrest Warrants and Search Warrants. All Law Enforcement are to carry out these warrants until they expire.
SECTION VII - The Supreme Court is responsible for voting on Judicial Reviews that are requested by the Lieutenant Governor, Speaker of the House, President Pro Tempore, Speaker Pro Tempore, and Congress. For the Judicial Review to move to Congress, the Supreme Court must reach a majority (2/3).
SECTION VIII - The Supreme Court does not have direct jurisdiction to remove any individual from office without a congressional trial. The Supreme Court may not suspend any member of Congress without the consent from the Presiding Officer of said person's Chamber.
SECTION XI - If the defendant in a case is found guilty, the Presiding Judge is responsible for handing down the punishment and ensuring that it is enforced by contacting the Chief Justice and/or his/her assistants.
SECTION X - The Prosecution/Defense has 10 minutes to join the server prior to the case being shouted at the time agreed upon with both sides. If one party fails to attend, the verdict automatically favors the party who did show up. If both parties do not attend, the case is a mistrial.
SECTION XI - All official cases must be held at an approved Court House. The Chief Court Justice has the ability to approve Court Houses. They must include; Judge's Chambers, Jury Seating, Jury Room, Bailiff Room and Tools, Witness Stand, Judge's Bench, proper teams, and a Bench for both the Prosecution and Defense.
SECTION XII - An Assistant Chief Court Justice chosen by the Chief Court Justice is responsible for managing Judicial Capital Staff. |
