The question is, was the killing of Awlaki legal? All American citizens are guaranteed: "In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defence." Now, under normal circumstances, the killing of any accused criminal is clearly unconstitutional. But does Awlaki's affiliation with al-Qaeda change anything? Does it make him an enemy combatant no different than a non-American citizen? IMO, he was in fact an enemy combatant that had renounced his American citizenship. He was killed on the battlefield and was entitled to no trial. What say you?
