A BILL TO DEFINE MILITARY POLICE JURISDICTION BE IT ENACTED BY THE STATE OF FIRESTONE CONGRESS HERE ASSEMBLED THAT: PREAMBLE: Realistically, the National Guard Military Police (LAWCOM) serve wherever National Guard Military Personnel are present, including abroad. However in the State of Firestone, Military Police only enforce laws and regulations to National Guard personnel. As it currently stands, this must be done so without proper arrest tools or citation booklets. Currently, trespassing in National Guard base cannot be enforced by the National Guard alone; they must call FSP to arrest the citizen(s). SECTION 1: Currently, National Guard Military Police (LAWCOM) may only enforce regulations of the National Guard and the laws permitted to them, to National Guard personnel. SECTION 2: LAWCOM may enforce laws to all offenders in the National Guard jurisdiction, or when requested to respond by the Firestone State Police, Stapleton County Sheriff’s Office, or Department of Homeland Security. SECTION 2B: LAWCOM applicants will be required to be POST Certified upon acceptance in the sub-division. SECTION 2C: LAWCOM personnel shall be able to enforce all laws in National Guard jurisdiction, that law enforcement agencies, and the Department of Homeland Security may enforce. SECTION 2D: LAWCOM personnel shall receive proper tools to enforce these laws that they have not already received, including arrest baton and citation booklet. Other NG members shall not receive tools that permit them to arrest, or write a citation. SECTION 2E: LAWCOM may not enforce vehicular traffic enforcement without a vehicle equipped with red and blue flashing lights, overhead spotlights, proper sirens, or other vehicular requirements on state law enforcement vehicles. SECTION 2F: National Guard’s jurisdiction (when not in State of Emergency, requested by law enforcement or the Department of Homeland Security, or ordered by the Governor or Lt. Governor of Firestone) shall be limited to 75 studs outside their front entrance of their base. SECTION 2G: When requested by law enforcement, or the Department of Homeland Security, the jurisdiction of the National Guard shall be expanded to county wide enforcement, until dismissed but the calling department. SECTION 2H: When requested by law enforcement, or the Department of Homeland Security, National Guard must respond in a timely manner to the scene, and will not be required to follow road signage or traffic lights. Upon dismissal, National Guard will respond in a timely manner back to base, and will be required to follow all road signage and traffic lights. SECTION 3D : Traffic enforcement shall be defined as performing traffic stops, checkpoints and vehicular pursuits. SECTION 4: The Office of the Governor and the National Guard General shall be responsible for enforcing this legislation. SECTION 5: Upon passage, this legislation shall go into effect immediately SECTION 6: All laws in conflict with this legislation are hereby declared null and void.
