City Of Ashton Charter ------------------------------------- Article I Introduction Section 1: This document shall be known as the City Charter (also referred to as "charter") This document applies to the City of Ashton and its citizens. No citizen, regardless of rank, with the exception of the group holder and managers for special reasons, is exempt from this charter. Section 2: The Government provided by this Charter shall consist of an elected Council which shall constitute the legislative branch of government and an elected mayor who shall run the government and a deputy mayor who will oversee the Council and its legislative matters. ------------------------------------- Article II Legislative Operations Section 1: There shall be five (5) permanent seats on the City Council. All positions are elected for 4 months to be concurrent with the term of the Mayor. The deputy mayor shall preside over the Council and all its legislative matters. The Mayor shall have the power to dismiss any councilperson that is found to be unfit, incompetent, corrupt, inactive, or any reason deemed necessary from the City Council. This action may be challenged by public referendum should a petition of at least twenty (20) signatures produced by Ashton citizens arise. A simple majority ([1/2]+1) is required to affirm the referendum with a minimum voting period of 24 hours. Section 2: City Council has the legislative authority to pass municipal laws known as Bills, Acts, or Ordinances. Bills require a minimum of three (3) votes to be passed. Once an ordinance has been passed the Mayor has ten (10) days to sign the ordinance into law. The Mayor shall carry the power to veto ordinances passed by the Ashton City Council if he chooses to do so. A veto may be overturned with a super majority ([2/3]+1) vote. Section 3: In cases of a vacancy of a City Council Member position, the Mayor shall be vested with the power to call for special elections to fill in those positions. Section 4: Relevant forums must be updated within seven (7) days of an ordinance, resolution, right or amendment being passed by the Ashton City Council. ------------------------------------- Article III Executive Operations Section 1: The Mayor shall be the Chief Executive Officer of the City. All executive and administrative authority of the City shall be vested in the Mayor and exercised by him/her, in the manner and subject to the limitations as hereafter set forth in this Charter. The Mayor in his executive capacity shall supervise and direct the operations of all departments of the City. Section 2: Removal of the Mayor shall require a public referendum initiated by a petition composed of at least fifty (50) signatures by Ashton citizens. A simple majority ([1/2]+1) is required to affirm the referendum with a minimum voting period of 24 hours. ------------------------------------- Article IV Judicial Operations Section 1: The Ashton Judicial branch shall be lead by the City Attorney of Ashton who would facilitate the law enforcement of the city and hold the authority of Chief Law Enforcement officer within Ashton. Section 2: The City Attorney may issue search warrants for the seizure and arrest of a specific person or a group of people. Section 3A: The City Attorney may implement any courts to the city government within Ashton in addition to those mentioned below if necessary to ensure the streamlined operation of the courts. Section 3B: There are 2 levels of cases. Trial, and Appellate. Cases start out in Trial courts. If one is unhappy with the result there they may appeal their case decision in the Appellate court to be affirmed, reversed, amended, or remanded. Once a verdict has been made in the appeal courts, no further action may be taken on it by the judicial branch. Section 3C: The City Attorney is not to preside over a case as this would create a conflict of interest. ------------------------------------- Article V Section 1: The Council reserves the power to amend the City Charter.
